The Minnesota Court of Appeals published a favorable opinion for an SPOE real estate client on Monday May 12.  For the full opinion, click on the docket number  below:

A13-0707      John Kalenburg, et al., Appellants, vs. Thomas H. Klein, et al., Respondents.
          Wright County District Court, Hon. Geoffrey W. Tenney.
A residential-property purchase agreement providing that it cancels by its own terms and that either the buyer or the seller may obtain a declaratory cancellation under Minnesota Statutes section 559.217, subdivision 4 (2012), permits, but does not require, a declaratory cancellation.
Affirmed and remanded in part.  Judge Carol A. Hooten.
